Functions of the General Government Contracts Department
The department exercises the powers vested in it according to the dissolved Coalition Provisional Authority Order No. 87 of 2004.
The department takes over
1- Expressing opinion and legal advice to governmental and private sector contracting parties.
2- Preparing and following up draft laws, regulations, instructions, controls and circulars related to contracting procedures.
3- Developing, preparing and amending standard documents for different types of contracts.
4- Find out the training needs in the field of government contracting and implement them in accordance with the approved plan and outside the plan and as required by the needs of the contracting parties.
5- Auditing government contracting procedures upon its request.
6- Updating the department’s website by providing it with information and data related to contracting procedures.
7- Receipt of requests from government contracting authorities, which include a request to include contractors who breach their contractual obligations in the black list and the list of lagging companies, and present them to the central committee formed in the Ministry of Planning for the suspension, listing, and lifting of those breaching their contractual obligations.
8- Follow up the preparation of contractual plans for government contracting agencies.
9- Follow-up and supervise the performance of the contracting formations in the government contracting authorities.
10- Managing the Help Desk for inquiries related to contracts.

A brief overview of the HELP DESK

In order to ensure the sustainability of the outputs of cooperation between the Ministry of Planning / General Government Contracts Department and the contracting parties, the help desk was established. The main objective of the office’s activity is to provide assistance to the contracting parties in all matters relating to (standard bidding documents, government contract execution instructions, Contracting plan for ministries and agencies not associated with a ministry and governorates, annual training plan, contract inquiries, Field visits and the reports that resulted from them…etc.)

Office tasks and work mechanism:

The office will be under the direct supervision of the Director General of the General Government Contracts Department, where the office carries out its tasks through the departments of the General Government Contracts Department (consulting and training, coordination and follow-up, tenders and contracts, Contractors and bidders information) and the tasks were distributed among the departments to work on:

Providing technical assistance to the contracting parties regarding any inquiries or clarifications about any issues that the contracting parties may face during the contracting process and the implementation of the contract.

Respond to any inquiries or clarifications within a period not exceeding 72 hours of receipt of all types of correspondence, with the exception of consultations that require a decision, so the answer to them will be within a week as a maximum, through the Coordination and Follow-up Department and in coordination with the rest of the departments in the department. Reviewing it and reflecting what results from it on its instructions and controls or circulating it to ensure the development of the contracting system and reduce inquiries.

Auditing the contracts to be contracted and contracted by the various contracting parties and marking notes on them for guidance and modification.

The purpose of establishing the Help Desk is to be a new window for the Government Contracts Department to communicate with the private sector and the various contracting parties and the channel through which technical advice is given in everything related to the implementation of contracts and as quickly as possible away from bureaucratic methods and under the direct supervision of the Director General of the Department to answer questions Inquiries, consultations, follow-up and audit of contracting procedures.

The number of consultations issued through the Help Desk is as follows:

1- The number of consultations issued for the year (2015) since the date of opening the office on 9/15/2015 reached approximately 47 consultations.

2- The number of consultations issued for the year (2016) was approximately 485 .

3- The number of consultations issued for the year (2017) was approximately 1960 consultations.

4- The number of consultations issued for the year (2018) until 1/11/2018 reached approximately 1099 consultations.

5- The number of consultations issued for the year (2019) was approximately 1,538 .

6- The number of consultations issued for the year (2020) reached approximately 1,186 .

7- The number of consultations issued for the year (2021) reached approximately 829 .

– (Project to support contracts through the creation of a diploma in public contract management and the development of scientific, academic and training cooperation).

Funding party: El Alamein Institute for Postgraduate Studies.

  1. Cooperation in the creation of a diploma in public contract management at the institute, so that it is among the specializations of the institute in which it is taught.
  2. Cooperation in the field of commercial arbitration and settling contract disputes through the methods and means agreed upon between the two parties.
  3. Cooperation in the field of exchanging scientific and academic experiences between the two parties and benefiting from the graduate studies campaign in supervising and scientific evaluation of postgraduate students.
  4. Cooperation in the field of benefiting from the outputs of the relevant departments by providing the Ministry of Planning with letters and dissertations that are related to the tasks of the Ministry of Planning from the departments in the institute.
  5. Cooperation in the field of holding seminars and conferences on topics of common interest between the two parties and according to their competence.
  6. Cooperation in the field of holding training courses and developmental workshops for the employees of the Ministry of Planning at the Institute.
  7. Cooperation in the field of exchanging experiences and conducting joint scientific research in various disciplines between the two parties.
  8. Cooperation in the field of exchanging scientific, cultural, artistic and literary publications and books.
  9. Cooperation in any other matter agreed upon by the two parties in the future and according to the changes and developments within the topics of the implementation of the memorandum.

Fourthly: Internal cooperation program:

– (A project to hold workshops and training courses that are at a basic and advanced level in the concept of arbitration, its mechanisms and procedures, in addition to dealing with both the Washington Convention for the Settlement of Investment Disputes, as well as the New York Convention on the Recognition and Implementation of Foreign Arbitration Judgments of 1958 for all contracting parties in the public and private sectors).

  1. Cooperation in the field of setting up development workshops on international commercial arbitration at two levels (basic and advanced).
  2. Cooperation in the field of holding awareness workshops related to Iraq’s accession on 11/17/2015 to the Washington Convention on the International Center for Settlement of Investment Disputes between States and one of the nationals of other countries organizing the Convention of 1965 (the oxide agreement), which entered into force 30 days after accession.
  3. Presenting the studies that are currently being conducted on the existence of a trend by the Iraqi government, and given the development taking place on the economic and commercial levels, due to Iraq’s accession to the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards of 1958.
  4. Cooperation in the field of defining international organizations that wish to cooperate with Iraq on the concepts of arbitration and the need to adopt international standards in this field.

Pushing universities towards modernization and development in curricula and research for engineering, management, economics and law disciplines towards spreading the concepts of public procurement and contract management in order to respond to the needs of society in the reconstruction of infrastructure and keeping pace with scientific progress in the world in the field of sustainable development.
  4. Expanding the base of coordination between specialized Iraqi universities, state sectors, and the private sector in order to achieve a long-term training program in the field of procurement and contracts, as well as developing curricula and conducting research in this field for the purpose of benefiting from its results in these sectors.
  5. Creation of advanced cadres in the field of training and capacity building.
  6. Building a solid knowledge base of laws and instructions for supplies and contract management in line with the rules approved regionally and globally.

– (A project to prepare (6) specialized standard documents in addition to the unified contracting directory and prepare a training strategy that includes preparing trainers (TOT) in the field of contracting for all contracting parties in Iraq.

The purpose of the training courses is to acquaint the participants with the provisions of the application of the instructions for the implementation of government contracts, controls and requirements before preparing the tender documents (which are related to the preparation of the technical and economic feasibility study or the technical reports related to bills of quantities for projects including the estimated cost and the preparation of maps, designs, bills of quantities, etc.) and the methods of contracting and introducing the Central Committee for Review And endorse the assignment and its powers, as well as the committees for opening and analyzing bids, and introducing the participant to how to deal with delay fines, insurances, contract extensions, and the legal effects resulting from breach of the contract and the prohibition of contracting, as well as the controls for facilitating the implementation of the provisions of the above instructions. For the purpose of upgrading the level of qualitative and specialized contracting, similar to what is practiced internationally, and to achieve the principle of transparency and integrity, and the need for Iraq to communicate with the international community, the Ministry of Planning, represented by the General Government Contracts Department, in cooperation with the World Bank, sought to issue (18) eighteen standard documents for tenders. These documents were launched in March 2014.
